RE: The tariff classification of a woman’s sleep bottom from China

Dear Ms. Miller:

In your letter dated April 7, 2008, you requested a classification ruling. Your sample will be returned to you.

Submitted sample, style #818555, is a woman’s sleep bottom constructed from 100% cotton woven fabric. The sleep bottom features a partially elasticized drawstring waist secured by one button at the waist, a fly front opening, a small monogrammed patch pocket on the upper right panel and long hemmed legs with side vents.

The applicable subheading for the style #818555 will be 6208.91.3010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of cotton: other: women’s. The duty rate will be 11.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change. Style #818555 falls within textile category 352. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
